Honduras Parliament Enacts Law Banning Sale of Energy Drinks to Minors

The Honduran Parliament recently passed a legislation aimed at protecting the health of minors by prohibiting the sale of energy drinks to individuals under the age of 18. This move comes as a significant step toward safeguarding the well-being of young people in Honduras. The law, titled "Energy Drink Control and Regulation Act," outlines specific measures to regulate the sale and consumption of these beverages.

In a unanimous decision, the Honduran Parliament convened for a full session and approved the implementation of the Energy Drink Control and Regulation Act. This legislation imposes a strict ban on the sale of energy drinks to individuals below the age of 18, recognizing the potential health risks associated with these beverages.

Energy drinks, defined as non-alcoholic functional beverages with stimulating effects on the nervous system, contain ingredients such as caffeine, taurine, B-vitamins, as well as substances like ginseng, guarana, mate, carnitine, nucleotides, and glucuronolactone, which are known for their physiological effects or nutritional value.

The law prohibits the sale of energy drinks in various locations nationwide. These include public and private primary and secondary schools, universities, kindergartens, sports facilities, community centers, and other institutions responsible for the care of individuals under the age of 18.

Furthermore, the legislation mandates the Honduran Health Regulatory Authority (Arsa) to issue standardized regulations regarding the composition, labeling, advertising, and sale of energy drinks. These regulations are designed to ensure the smooth implementation of the law. The labels of energy drinks must prominently and clearly display information regarding the adverse effects, health risks, and danger warnings associated with their consumption. The health regulatory authority will also update the label content regularly to include the latest scientific and medical findings on the negative effects of consuming energy drinks.

To enhance enforcement, the law requires vendors selling energy drinks to separate them from other beverages and display signs stating "Prohibited for sale and consumption by individuals under 18 years of age."

Additionally, the legislation grants the health regulatory authority the responsibility to monitor compliance with the law and its related regulations, as well as impose penalties for any violations.
