The Measures for the Supervision and Administration of the Production and Operation of Cosmetics will be officially implemented on January 1, 2022
As China’s first departmental regulation specifically for the production and management of cosmetics, the "Measures for the Supervision and Administration of Cosmetics Production and Operation" (hereinafter referred to as the "Measures") clarify the cosmetics production license, production management, operation management, supervision and management, legal responsibilities, etc. Regulation. It is one of the important supporting documents for the implementation of the "Regulations on Cosmetics Supervision and Administration" on the supervision and management of cosmetics production and operation.
As China's first regulatory document specifically for children's cosmetics, the "Children's Cosmetics Supervision and Administration Regulations" (hereinafter referred to as the "Regulations") further clarify and improve the supervision measures for children's cosmetics, and provide legal guarantees for strengthening the supervision of children's cosmetics.
The "Regulations" covers the definition, labeling, formula principles, safety assessment, random inspection, production and operation, and management scope of children's toothpaste for children's cosmetics. For example, it is clearly stated that children’s cosmetics should be specially labeled, and words such as “food grade” and “edible” or food-related patterns are prohibited. Submit technical materials such as product formulas, inspection reports, safety assessment materials, etc.
In accordance with the "Technical Guidelines for Cosmetic Safety Evaluation (2021 Edition)" (hereinafter referred to as "Technical Guidelines"), from January 1, 2022, cosmetic registrants and recorders must apply for special cosmetics registration or general cosmetics registration Carry out cosmetic safety assessment in accordance with the requirements of the "Technical Guidelines" and submit product safety assessment materials. Before May 1, 2024, cosmetics registrants and recorders can submit a simplified version of the product safety assessment report in accordance with the relevant requirements of the "Technical Guidelines."
In order to regulate the use of cosmetic labels and protect the legitimate rights and interests of consumers, the "Administrative Measures on Cosmetic Labels" (hereinafter referred to as "Measures") will be officially implemented on May 1, 2022.
The "Measures" clarify the main responsibilities of cosmetics registrants and filing parties, and the principle requirements for the content and form of cosmetics labels. At the same time, it stipulates the content and detailed requirements for labeling of cosmetics labels, and prohibits labeling of cosmetics labels. Provisions were made. The main contents are: cosmetics must have Chinese labels; cosmetics trial packs and minimum sales units must also have labels; the content of not more than 0.1% must be marked as "other trace ingredients" as a guide, and the use of medical terms and medical celebrities are prohibited. The name or the name of the medicine, etc., expressly or imply that the product has a medical effect.
Starting from May 1, 2022, the labels of registered/recorded cosmetics must comply with the provisions and requirements of the Measures; registered/recorded cosmetics must be updated in accordance with the new regulations before May 1, 2023.
According to the "Rules for Classification of Cosmetics and Classification Catalog", for ordinary or special cosmetics that have been registered or completed the filing before May 1, 2021, the cosmetics registrant and filing person shall pass the cosmetics registration filing information service platform before May 1, 2022 Supplement to provide product classification codes.
The implementation of new regulations, new regulations, new standards, and new norms are all disruptive to the industry.
