FDA Proposes Nationwide Ban on Brominated Vegetable Oil (BVO) in Food Additives, Continues Safety Assessment of Chemicals

On November 2, 2023, the U.S. Food and Drug Administration (FDA) took a significant step by proposing a ban on the use of specific food additives, specifically targeting brominated vegetable oil (BVO). Simultaneously, the FDA announced its ongoing commitment to assessing the safety of various other chemical substances used in food.

As a petition started 10 years ago asking Pepsi to stop adding BVO in Gatorade, this food additive has become highly controversial since. In 2014, both Coke and Pepsi dropped brominated vegetable oil in their formula. And in 2020, Mountain Dew also dropped it from its main line. However, BVO is still found in some consumer drinks.

The FDA's prioritization of chemical reviews in food aligns with a risk-based approach, emphasizing scientific analysis and regulatory authority. Despite BVO having a historical track record as a generally recognized safe substance (GRAS), the FDA is diligently examining it to comprehensively comprehend potential health implications. This scrutiny is not isolated to federal efforts, as California has recently implemented measures prohibiting the use of four food ingredients, including BVO, within the state. The FDA's actions extend beyond California, as the proposed ban on BVO is intended to be nationwide.

Furthermore, the FDA is actively engaged in reviewing and reassessing the safety profiles of various chemicals commonly used in food products. As part of these efforts, the FDA is presently evaluating color additive regulations, particularly those authorizing the use of FD&C Red No. 3 in drugs and foods, encompassing dietary supplements. This regulatory process underscores the FDA's commitment to prohibiting the use of color additives that exhibit carcinogenic effects in animals or humans when consumed.
