Lhasa fined nearly 750,000 yuan in 59 trademark infringement cases

With the increase of trademark registration in Lhasa year by year, in order to effectively safeguard the exclusive rights and interests of the majority of market participants, in recent years, Lhasa Municipal Market Supervision and Administration has steadily increased its efforts to protect the exclusive rights of registered trademarks, focusing on well-known trademarks, geographical indications, foreign-related trademarks and old-name registered trademarks, and carrying out enforcement actions to protect the exclusive rights of registered trademarks in various aspects. It has created a fair competitive market environment and a safe and reassuring consumption environment. In July, 2018, the Lhasa Market Regulatory Bureau seized 117 boxes of counterfeit sports shoes suspected of infringing the exclusive rights of trademarks in a warehouse in the western suburbs, involving famous trademarks such as "Hongxing Erke", "Nike", "Adidas", with a total value of nearly 2 million yuan, which is the largest foreign trademark infringement case in recent years. In April this year, the Lhasa Market Supervision and Administration Bureau received an application from Shanxi Xinghua Village Fenjiu Liquor Co., Ltd. to defend its rights. Through the joint efforts of government and enterprises to crack down on counterfeiting, more than 1,000 bottles of Fenjiu and Zhuyeqing series of infringed liquors were found, worth more than 90,000 yuan, which effectively safeguarded the legitimate rights and interests of market participants. In addition, according to the requirements of the Rural Counterfeit Food Control Program, Lhasa Municipal Market Supervision Bureau, Lhasa Municipal Business Bureau and Lhasa Municipal Public Security Bureau jointly carried out the rural counterfeit control work. We inspected 1046 food operators, 35 wholesale and fair markets, organized 12 food safety publicity campaigns, and dealt with 7 unlicensed businesses. In the past three years, 59 trademark infringement cases have been investigated and punished, with the amount of fines amounting to 747.8 million yuan.

"In order to further standardize market participants and strengthen the supervision of trademark credit, we will incorporate information such as administrative penalties for trademark infringement, counterfeiting and illegal trademark agency into the enterprise credit information publicity system, form coordinated supervision and joint punishment for trademark dishonesty, and implement the supervision of trademark'double random and one public'." Lhasa City Market Supervision and Administration reminds the market participants that they should seek legal aid in time if they find that others infringe upon their exclusive right to use registered trademarks. According to the relevant provisions of the Trademark Law, the protection of trademark rights implements a "two-track system". That is, both judicial and administrative organs have the right to deal with trademark infringement and counterfeiting cases accordingly.
