Federal Appeals Court Overturns EPA Ban on Chlorpyrifos for Food Crops
In a significant development, a federal appeals court has overturned the U.S. Environmental Protection Agency's (EPA) 2021 ban on the pesticide chlorpyrifos in food crops. The ban, aimed at addressing concerns about the pesticide's link to brain damage in children, covered various crops, including sugarbeets, soybeans, broccoli, cauliflower, fruit trees, and wheat.

The 8th Circuit Court of Appeals, responding to a lawsuit against the EPA, ruled that the agency did not adequately consider whether there were safe agricultural applications for chlorpyrifos when implementing the ban. The decision to ban chlorpyrifos followed a prior court ruling from the 9th Circuit, instructing the EPA to either modify or revoke tolerances and approved uses for the pesticide within 60 days. The 8th Circuit contends that the 60-day deadline compelled the EPA to hastily revoke all tolerances for chlorpyrifos without thoroughly evaluating potential safe uses.
According to the 8th Circuit's opinion, just before the 9th Circuit's order, the EPA had identified 11 high-benefit agricultural uses that could achieve the necessary margin of safety if other uses were revoked. The margin of safety is determined based on the EPA's confidence that no harm will result from aggregate exposure to the pesticide chemical residue. However, due to the tight deadline imposed by the 9th Circuit, the EPA opted for a complete ban on chlorpyrifos.
The 8th Circuit judges emphasized that while the EPA had to act swiftly, a short deadline is not an excuse for narrowing down to a single solution without considering other options.

Despite the overturning of the EPA's broad ban on chlorpyrifos, the 8th Circuit clarified that the agency retains the discretion to reinstate the prohibition after a thorough review, as long as it considers all important aspects of the problem and provides a reasoned explanation for its decision.
