Selling 8 rolls of unqualified waterproofing rolls, fined for illegal gains

Don't take evil as small! Recently, a merchant in Longchang, Sichuan, was punished for selling eight unqualified rolls of waterproofing rolls, confiscating more than 200 yuan of illegal income and fining more than 1300 yuan.

In mid-April last year, when the law enforcement officers of the former Longchang Bureau of Industry and Commerce conducted spot checks on a merchant under their jurisdiction according to law, they randomly sampled and inspected two batches of polyethylene-polypropylene (polyester) macromolecule waterproofing rolls produced by Weifang Waterproofing Material Co., Ltd. Tested by professional institutions, the tensile strength and tear strength of the above two batches of waterproof rolls do not meet the requirements of the standard. The appraisal conclusion is that all the products are unqualified. The original Longchang Bureau of Industry and Commerce conducted a case investigation on the merchant according to law.

After investigation, the two batches of unqualified waterproofing coils were purchased by the parties from a waterproofing material limited company in Weifang in early 2018, 5 volumes and 3 volumes (87m/volume) respectively. Except for sample preparation, the rest were sold, and the profit was more than 200 yuan. The aforementioned acts of the parties violate the provisions of Article 39 of the Product Quality Law of the People's Republic of China, which states that the Sellers shall not sell products by adulteration or adulteration, or by pretending to be genuine or inferior, or by pretending to be qualified products by unqualified products. It is an illegal act to sell products by pretending to be qualified products by unqualified products.

According to Article 50 of the Product Quality Law, if adulteration or adulteration occurs in a product, the product is adulterated by falsification, suboptimal or impersonated by unqualified products, the production and sale of the product shall be ordered to stop, the product illegally produced or sold shall be confiscated, and a fine of more than 50% and less than three times the value of the product illegally produced or sold shall be imposed. If the case is serious, the business license shall be revoked; if the case constitutes a crime, criminal responsibility shall be investigated according to law." Recently, Longchang Municipal Market Supervision and Administration has imposed the following penalties on the merchant according to law: confiscating 5 meters each of the two batches of unqualified waterproof rolls that have not yet been sold; confiscating more than 200 yuan of the illegal income of the parties; and imposing a fine of more than 1300 yuan on the parties.
