Shandong Province officially issued chemical industry park expansion management measures!
On October 25, the General Office of Shandong Provincial People's Government officialy issued the addminitratives measures on the expansion of Shandong chemical industry (Trial) (Hereinafter referred to as the Measures). Compared with the earlier draft for public comments, the Measures adjusted some conditions and procedures for expanding areas, and added a chapter on "Management of expanding areas".
According to the Measures, the comprehensive management assessment score of the chemical industrial park applying for expansion shall be no less than 80 points, the operating income of the leading industry in the park shall account for more than 60% of the total operating income of the park, the per mu output value of the completed projects shall not be less than 3 million Yuan, and the developed and utilized area shall not be less than 80% of the existing area of the park. In the draft, the requirement is not less than 85 points, the average output value per mu is not less than 4 million yuan. In addition, the Measures also adjusted the content and sequence of other conditions.
In terms of the producers for the expansion of the chemical industrial park, the measures mentioned that the administrative authority of the industrial park shall submit the application documents and relevant materials for the expansion of the industrial park to the local government according to the subordinate relationship. In the scope of all submissions, compared with the draft for soliciting comments, the Measures added a term "Management plan for the Expanded Zone".
In addition, the Measures added a chapter on "Management of Zone Expansion", and listed two contents, respectively: "The announced zone expansion shall be constructed in accordance with the national and provincial standards, and the construction of chemical projects in line with the policy requirements can be undertaken at the same time. Before the project is put into operation, the expanded area of the park shall pass the inspection and acceptance organized by the provincial Special Action Office of Chemical Industry." "In principle, the provincial government will no longer identify new key chemical monitoring points, and qualified counties (cities, districts) can gradually incorporate the identified and announced key chemical monitoring points into the management of the park. Where the key chemical monitoring points are merged into the park, they may not be clustered together with the park, but must be within the same county (city, district) jurisdiction, and a single park shall not exceed three areas, and shall be under unified management with the existing park." But those two items appear in other sections of the draft.

Administrative Measures of Shandong Province on the Expansion of Chemical Industry Park (Trial)
Chapter I General Provisions
Article 1 In order to standardize the expansion of chemical industrial parks in the province and promote the high-quality development of chemical industry, According to the Ministry of Industry and Information Technology and so on six departments about print and distribute "chemical industrial park construction standard and classifying management measure (trial)" notice (former ministry of al [2021] no. 220), the Ministry of Industry and Information Technology and so on six departments on the "difference" to promote the development of high quality petrochemical chemical industry guidance "(former ministry of al [2022] no. 34) and other documents, These Measures are formulated in light of the actual situation of Shandong Province.
Article 2 These Measures shall apply to the chemical industrial parks and specialized chemical industrial parks recognized by the provincial Government (hereinafter referred to as "Parks").
Article 3 The relevant departments of the municipal/county (city/district) governments shall be responsible for the relevant administration of the expansion of the Park according to their duties.
Chapter II Conditions for area expansion
Article 4 The comprehensive score of the management assessment of the chemical industrial park shall not be less than 80 points.
Article 5 The operating income of the leading industries in the park shall account for more than 60% of the total operating income of the park, the average output value per mu of the completed projects shall not be less than 3 million Yuan, and the developed and utilized area shall not be less than 80% of the existing area of the Park.
Article 6 The utilization load of the existing centralized sewage treatment facilities in the park shall not exceed 80% of the treatment capacity. In case of more than 80%, there must be an expansion project of sewage treatment facilities that is being implemented or has completed the project approval procedures, and the utilization rate of the treatment capacity after completion meets the above requirements.
Article 7 No major or more environmental emergencies have occurred in the park within two years, and no prominent ecological and environmental problems have been pointed out by the central and provincial ecological and environmental protection inspectors in the current year. There are no environmental protection issues due to outstanding ecological problems, such as limited approval, listed supervision and deadline rectification unfinished.
Article 8 No major production safety accident or above has occurred in the park in the past two years, and the safety risk assessment grade shall be general or low safety risk.
Article 9 In principle, the expanded area shall be connected with the park. The site selection and layout shall comply with relevant laws, regulations, policies and territorial space planning, and shall be incorporated into the centralized construction area within the urban development boundary determined by the territorial space planning. Before the approval of the territorial space plan, it shall conform to the general plan for land use, the plan for main functional areas and the general plan for cities (towns).
Article 10 The expanded area shall be included in the overall development planning of the park. The overall development plan shall include chapters on production safety, emergency rescue, ecological and environmental protection, economical and intensive land use, and comprehensive disaster prevention and mitigation, or the above contents shall be independently prepared in a special plan, which shall be consistent with the relevant plans of the city, county (city, district).
Article 11 The expanded area shall be included in the industrial development planning of the park. The industrial development plan shall be formulated according to the local basic conditions such as land resources, industrial foundation, water resources, environmental capacity, urban construction, logistics and transportation, and shall be in accordance with the national and provincial industrial policies and the development plan of chemical industry.
Article 12 The expansion area shall carry out planning environmental impact assessment and overall safety risk assessment including site selection safety assessment according to law, and strengthen hazardous chemicals management according to regulations.
Article 13 the expansion area within the scope of four shall not has the sensitive spots such as schools, hospitals, human settlement and labor-intensive enterprise, administrative office, living service personnel in the park centers and dangerous chemicals production and storage areas separated, safe distance should conform to the requirements of the relevant standards, can not have social road crossing, have closed management requirement.
Article 14 The security protection distance between the expansion area 4 and the boundary, urban built-up areas, densely populated areas, important facilities and sensitive targets shall meet the requirements of relevant regulations, and the security control line of surrounding planning shall be set up, and a buffer belt shall be left to meet the requirements of the regulations.
Article 15 the expansion of the regional red line should meet the ecological protection, the environmental quality of the bottom line, online resource utilization and ecological environment access list and other related requirements, it is strictly prohibited in the earthquake fault, prone to geological disasters and permanent basic farmland, nature reserve, drinking water sources reserve, and other environmentally sensitive areas, the location of the area.
The third chapter expands the area procedure
Article 16 The ADMINISTRATIVE authority of the PARK shall submit the application documents and relevant materials for the expansion of the PARK to the local government according to the subordination relationship. Related materials mainly include:
(1) Basic information of the park and the expanded area, land use, the project to be implemented, and the guarantee of the elements required for project construction.
(2) The overall development plan of the Park, the industrial development plan of the Park and other plans and approval documents.
(3) Approval documents for the national spatial planning of the city/county (city/district) where it is located and documents certifying the use of land according to law; Relevant map data, including the map of the expanded area (marked with the base map of the legally approved territorial space planning map and satellite image map) and coordinates of boundary points (2000 National Geodetic Coordinate system).
(4) Environmental impact statement and review documents, or follow-up evaluation report and review documents, and relevant certification materials of sewage treatment and utilization of the park and expansion.
(5) Overall safety risk assessment report.
(6) Planning water resources demonstration or regional assessment report of water resources demonstration and approval documents.
(7) the management plan of the park after the expansion.
(8) other materials that need to be supplemented.
(9) Commitment letter of authenticity of materials.
Article 17 The local government of the PARK shall organize relevant departments to examine and verify the materials submitted by the administrative authorities of the park, submit them to the higher government level by level, and send a copy to the competent chemical industry department at the higher level.
Article 18 Upon receipt of the application for expansion approved by the provincial government, the Special Group Office of Provincial Special Action for Chemical Industry and the Special Group Office for Accelerating High-quality Development of Energy-Intensive Industries (hereinafter referred to as "Provincial Special Action Office for Chemical Industry") shall organize relevant experts to review and verify on site those that meet the requirements.
Article 19 After passing the on-site inspection, the Provincial Special Action Office of Chemical Industry shall organize the relevant departments to conduct joint examination of the application materials for the expansion of the zone. After the joint examination is passed, the area and range of the expanded area of the park shall be publicized to the society. If there is no objection in the publicity, the provincial Special Action Office of Chemical Industry shall publish the expansion of the zone after the approval of the provincial government.
Chapter IV Management of expanded area
Article 20 The announced expansion areas of the park shall be constructed in accordance with the standards prescribed by the State and the province, and at the same time may undertake the construction of chemical projects that meet the policy requirements. Before the project is put into operation, the expanded area of the park shall pass the acceptance inspection led and organized by the provincial Special Action Office of Chemical Industry.
Article 21 In principle, the provincial government shall no longer designate new key chemical monitoring and control points, and counties (cities, districts) may gradually incorporate the identified and announced key chemical monitoring and control points into the park administration if conditions permit. Where the key chemical monitoring points are merged into the park, they may not be clustered together with the park, but must be within the same county (city or district) jurisdiction, and a single park shall not exceed 3 areas, and shall be managed in a unified manner with the existing park.
Chapter V Supplementary Provisions
Article 22 The PROVINCIAL Special Action Office for Chemical Industry shall be responsible for the interpretation of these Measures together with the relevant departments of the provincial government.
Article 23 These Measures shall take effect as of the date of issuance. In case of any inconsistency between previous provisions and these Measures, these Measures shall prevail.
