Falsely Advertising Products As Low-Fat And Sugar-Free, Fined Rmb60,000 By The Authority
Recently, the Shanghai Municipal Administration of Market Supervision issued an administrative penalty for Mancoten Food (Shanghai) Co. It is reported that Mancoten Food (Shanghai) Co., Ltd. was fined RMB 60,000 by the Shanghai Minhang District Market Supervision Administration for falsely advertising its products as "low-fat" and "sugar-free".
Tmall platform, the food products sold by "mankattan mankattan flagship shop" with the sales link (hereinafter referred to as "Mankattan Super Mellow Series Toast Bread Original Whole Wheat Toast Sandwich DIY Breakfast Food Casual Low Fat"), which was advertised as "low fat" on the link, but the nutrition facts list of the product stated "Fat per 100g 4.2g per 100g", which is not a low-fat product.
The above-mentioned act of the party allegedly violated the relevant provisions of the Law of the People's Republic of China on the Protection of Consumer Rights and Interests. The investigation was approved and a case was opened against the person concerned.

FOODS
The web pages on the online shops are designed, produced and published by the person concerned. On 20 August 2021, it published the sales link of "Mankattan Super Mellow Series Toast Bread Original Whole Wheat Toast Sandwich DIY Breakfast Food Casual Low Fat" on the webpage of "Mankattan flagship shop" on the Tmall platform.
After verification and confirmation by the parties concerned, the products sold by the link were Mancoten Super Mellow Original Bread, whose nutrition facts showed a fat content of 4.2 grams of fat per 100 grams of product, and Mancoten Super Mellow Wholemeal Bread, whose nutrition facts showed a fat content of 3.4 grams of fat per 100 grams of product, both of which were solid and did not meet the requirements of the General Guidelines for Nutrition Labelling of Prepackaged Food 28050-2011.

The use of the advertising term "low fat" in the sale of the Super Mellow series of original and wholemeal toast bread in the above-mentioned online shop was inconsistent with the reality.
On 20 August 2021, the party posted on the webpage of "Mancoton Flagship Store" in Jingdong Mall "[3 cans of 60g/can] Mancoton Nutty Cereal Crackers Snack Afternoon Tea Snack Biscuits Casual Sugar Free Food Snack 180g (3 cans) "The link was verified and confirmed by the parties concerned, and the names of the products sold on the link were "Mancoten Rye Nut Crackers", "Mancoten Chia Seed Fruit Crackers" and "Mancoten The person concerned provided a test report, which showed that the sugar content in "Mancoten Rye Nut Crackers" was 19.6g/100g and the sugar content in "Mancoten Chia Seed Fruit Crackers" was 16.1g/100g.
All the above three biscuits were solid and did not meet the requirements and conditions for energy and nutrient content claims in the General Guidelines for Nutrition Labelling of Prepackaged Foods 28050-2011, item: Carbohydrate (sugar), content claim mode: none or no sugar content requirement: ≤ 0.5g/100g (solid) or ≤ 00ml (liquid) standard provisions.
The use of the advertising term "sugar-free" in the sale of the nut and cereal brittle combination in the above-mentioned online shop did not correspond to the reality.
In accordance with the provisions of Article 20(1) of the Law of the People's Republic of China against Unfair Competition, the party was ordered to stop the illegal acts and was punished as follows: a fine of thirty thousand yuan (RMB 30,000).
In summary, the combined penalties are as follows: a fine of RMB 60,000 yuan (¥60,000).
