THE DETAILS The defendants have agreed to a settlement fund, totalling US$2.3 million, granting the full purchase price or average purchase price for covered products to settlement class members who submit a valid claim form.
Beiersdorf will also test for the presence of benzene for at least 18 months following the Preliminary Approval order.
THE WHY? The lawsuit alleged that Coppertone’s spray sunscreens were inappropriately marketed as the presence of benzene was not disclosed. The defendants maintain that the products have always been safe for use and deny all claims and any wrongdoing.
