Lilly Launches 4 Lawsuits to Halt Surge in Compounded Weight Loss Drug Copies

Eli Lilly has filed four separate lawsuits against U.S. compounding pharmacies over what it claims are unauthorized copies of its blockbuster weight loss drug tirzepatide, sold under the brand name Zepbound. These legal actions reflect growing tension between pharmaceutical innovators and compounders operating in regulatory gray areas.

The lawsuits target WellHealth, Brooksville Pharmaceuticals, New Drug Loft, and Better Life Pharmacy, accusing them of marketing compounded tirzepatide versions without FDA approval, thereby violating trademark and consumer protection laws. Lilly asserts that these unapproved copies put patient safety at risk and jeopardize the integrity of legitimate medical treatments.

Zepbound, approved in 2023 for chronic weight management, quickly became a bestseller, attracting interest from both patients and clinics. But its popularity has also led to widespread compounding, a practice permitted under U.S. law only when the commercial version is unavailable or in short supply.

Lilly argues that the compounded versions are not subject to the rigorous safety and efficacy standards imposed on FDA-approved drugs, creating a risk of inferior or contaminated products. The company is asking courts to issue permanent injunctions against further sales and to award financial damages.

This move by Lilly follows a similar wave of lawsuits by Novo Nordisk, which targeted unauthorized copies of its diabetes and weight loss drug semaglutide.
