India Dismisses Patent Infringement Claims Assures Commitment to IP Rights
June 11, 2025: Commerce and Industry Minister Piyush Goyal has refuted allegations that Indian pharmaceutical companies copy products from Swiss firms. Speaking to reporters, Goyal emphasized that India respects intellectual property rights (IPRs) and has no record of stealing patents, trademarks, or copyrighted technologies.
“No evidence of wrongdoing has been provided by Swiss pharma companies,” Goyal stated, calling such claims a long-standing myth. He also highlighted India’s strict patent laws, which prohibit the evergreening of patents, a practice where companies prolong patent monopolies through minor modifications.
Under Section 3(d) of the Indian Patents Act, patents for known drugs are restricted unless significant efficacy improvements are demonstrated. This prevents companies from extending exclusivity at the expense of affordable healthcare.
Goyal pointed out that EFTA member countries, including Switzerland, are collaborating with India on the India-EFTA trade agreement, showcasing mutual trust. “India offers a vast market and streamlined IPR processes, creating opportunities for global firms to thrive,” he noted.
The minister added that India’s pharmaceutical industry, serving a 1.4 billion-strong market, balances innovation with accessibility, ensuring global healthcare products remain affordable.
