Shandong No.1 Chemical Enterprise refused to correct its environmental pollution

The punishment decision shows that the Shandong Provincial Department of Ecology and Environment conducted on-site inspection of Tenggang Port Industry Co., Ltd. in Zaozhuang City from January 23 to 24, 2019. It was found that the materials (raw coal and coal washing) stacking sites of ports and wharfs did not take effective measures such as airtight, enclosure, covering, spraying, greening, setting up wind and dust suppression nets, etc. according to regulations. Dust measures; materials are loaded by conveyor belt dumping, and effective dust control measures such as airtight, closed and centralized collection are not adopted according to regulations.
The above actions have violated the provisions of Article 53 of the Regulations on the Prevention and Control of Air Pollution in Shandong Province. On February 1, 2019, the Shandong Provincial Department of Ecology and Environment served the Decision on Ordering the Correction of Illegal Acts, ordering them to stop the illegal acts immediately, and informing them that if they refuse to correct the illegal discharge of pollutants, the company will be punished continuously on a daily basis.
On February 22, 2019, the provincial environmental department found in the review that the company's material storage sites only take measures of covering and sprinkling dust prevention, but the coverage is not perfect, sprinkling water is not timely, and effective corrective measures such as sealing, enclosure and greening are not taken, which still cause dust pollution, which belongs to the category of "being ordered to rectify and refuse to change."
In accordance with the relevant provisions, on February 26, 2019, the Decision Instructing the Company to Correct the Illegal Acts was served, ordering the company to stop the illegal acts immediately, and informing the company that if it refuses to correct the illegal sewage discharge acts, it will continue to impose continuous penalties on a daily basis. On February 26, 2019, the Decision Instructing the Company to Cease Business and Rectify was served. The company was ordered to close down and rectify. On March 21, 2019, the Department of Ecological Environment delivered the Decision on Administrative Punishment to Tenggang Port Industry Co., Ltd. of Zaozhuang City, with a fine of 50,000 yuan. After hearing, the Shandong Provincial Department of Ecology and Environment decided to impose a continuous penalty on Zaozhuang Tenggang Port Industry Co., Ltd. from February 2, 2019 to February 22, 2019 (a total of 21 days): a fine of 1.05 million yuan.
Penalty Decision also mentions that if you refuse to accept the decision, you can apply to the Ministry of Ecology and Environment or the Shandong Provincial People's Government for reconsideration within 60 days from the date of receiving the decision, or you can directly sue the People's Court of Lixia District of Jinan City within six months from the date of receiving the decision. When applying for administrative reconsideration or instituting administrative litigation, the execution of the decision on administrative penalty shall not be stopped.
