The largest anti-monopoly ticket for APIs, 3 manufacturers were fined

Recently, the General Administration of Market Supervision investigated and dealt with a major and typical case of abuse of market dominance in the field of APIs in accordance with the Anti-Monopoly Law, and imposed administrative penalties on three calcium gluconate API distributors for monopolistic behavior.

 

Calcium gluconate injection is a national essential medicine, a clinically necessary drug, and is a commonly used low-cost medicine. The calcium gluconate raw material for injection is the basic raw material for the production of calcium gluconate injection. At the beginning of 2019, the General Administration of Market Supervision received a report reflecting that a pharmaceutical distribution company monopolized the calcium gluconate raw material for injection, resulting in a shortage of calcium gluconate injection supply and a sharp increase in prices, suspected of violating the Anti-Monopoly Law. The General Administration of Market Supervision immediately carried out verification work, and preliminary evidence reflected that Shandong Kanghui Pharmaceutical Co., Ltd. (hereinafter referred to as Kanghui Company), Weifang Puyunhui Pharmaceutical Co., Ltd. (hereinafter referred to as Puyunhui Company) and Weifang Taishen Pharmaceutical Co., Ltd. (hereinafter referred to as Sunshine Corporation) and other pharmaceutical distribution companies are suspected of controlling the sales market of calcium gluconate raw materials for injection and implementing monopolistic behavior. In May 2019, the General Administration of Market Supervision filed a case in accordance with the law to investigate the three aforementioned enterprises.

 

The behavior of the parties in this case was serious and bad in nature, and the General Administration of Market Supervision decided to impose heavy penalties on the parties in this case: Confiscate the illegal income of 108.9 million yuan from Kanghui Company, and impose a fine of 10% of 2018 sales, totaling 143.8 million yuan; a total of 2.527 100 million yuan. Puyunhui Company confiscated the illegal income of 6.05 million yuan, and imposed a fine of 9% of 2018 sales, totaling 48.3 million yuan; a total of 54.35 million yuan. The company confiscated the illegal income of 6.05 million yuan and imposed a fine of 7% of sales in 2018, totaling 12.4 million yuan; totaling 18.45 million yuan.
