Thailand's Food and Drug Administration has issued an amendment to regulations on foods containing cannabis or hemp

Ministry of Public Health, Thailand, October 25, 2022: Recently, the Food and Drug Administration of Thailand, in order to make it more clear for entrepreneurs and protect consumers from food safety, has issued amendments to the regulations for foods containing cannabis or hemp, which will come into effect on October 22, 2022.

1. Announcement No. 437 of the Ministry of Public Health of Thailand, Hemp seed, hemp seed oil, hemp seed protein and food products containing hemp seed, hemp seed oil or hemp seed protein ingredients (No.2). The regulation removes the requirement for maximum levels of CBD in cannabis products because CBD is present in very low levels in cannabis seeds and there are no safety concerns.

2. Announcement No. 438 of the Ministry of Public Health of Thailand, "Food containing cannabis or hemp Ingredients (No.2)". The regulation is a revision of the standards for food sold directly to consumers. For example, because the amount of seasoning used in cooking is small, the seasoning should contain no more than 0.0032% of THC and no more than 0.0028% of CBD. As for other foods, for foods not sold directly to consumers or sold only as raw materials, no more than 1.6 mg of THC and no more than 1.41 mg of CBD per packaged unit. In addition, the labelling requirements for foods containing cannabis or hemp ingredients have been revised.

3, Ministry of Public Health of Thailand Announcement No. 439 "Food containing cannabidiol extract (No.2)". The regulation adds details to the requirements for mixing CBD extracts with other substances. Revision of water solubility requirements for CBD extracts used in manufacturing processes or optimization for food processing. Revised dietary supplement form requirements and the maximum allowable amount of CBD extract used in dietary supplements.
