CIETAC Arbitration Tribunal Rejects All Claims by Hengrui Pharmaceutical in the Pralatrexate BD Dispute
In a recent development, the China International Economic and Trade Arbitration Commission (CIETAC) arbitration tribunal delivered its final verdict on the Pralatrexate BD dispute, dismissing all claims made by Hengrui Pharmaceutical. This decision comes after a series of events that have significantly impacted the stock prices and market value of both Hengrui Pharmaceutical and Wanchun Medicine. The Pralatrexate BD dispute centers around the collaboration between Hengrui Pharmaceutical and Wanchun Medicine. In August 2021, Wanchun Medicine announced the successful Phase III clinical trial results of Pralatrexate, a second-line treatment for non-small cell lung cancer. This news led to a more than twofold increase in Hengrui Pharmaceutical's stock price.
Subsequently, in August 2021, Hengrui Pharmaceutical entered into a cooperation agreement with Wanchun Medicine, subscribing to Wanchun's shares worth 100 million RMB and obtaining the rights to Pralatrexate in the Greater China region. Hengrui Pharmaceutical agreed to make an upfront payment and milestone payments totaling not more than 1.3 billion RMB.
However, the journey for Pralatrexate took a downturn when Wanchun Medicine's application for its market approval in the United States received a complete response letter (CRL) from the U.S. Food and Drug Administration (FDA) on December 1, 2021. Moreover, in March 2023, the National Medical Products Administration (NMPA) in China notified Wanchun Medicine that its application for Pralatrexate had not been approved.
Amidst these setbacks, a civil ruling by the Beijing Second Intermediate People's Court in September 2023 granted Hengrui Pharmaceutical's request to freeze 200 million RMB worth of assets owned by Dalian Wanchun Medicine Co., Ltd. This ruling further added to the turbulence surrounding Pralatrexate.
Finally, on January 10, 2024, the CIETAC arbitration tribunal delivered its final decision, rejecting all of Hengrui Pharmaceutical's claims in the Pralatrexate BD dispute. This ruling marks a significant setback for Hengrui Pharmaceutical, as it had sought to assert its rights and protect its investment in Pralatrexate.
The outcome of the CIETAC arbitration tribunal's decision is a blow to Hengrui Pharmaceutical's aspirations in the Pralatrexate market. The rollercoaster journey of Pralatrexate has resulted in a sharp decline in Wanchun Medicine's stock price, from a high point of $30 per share in August 2021 to a meager $0.9 per share at present, with a market value of only $34.65 million.
The CIETAC arbitration tribunal's rejection of Hengrui Pharmaceutical's claims in the Pralatrexate BD dispute has dealt a significant blow to the company's ambitions.
