Novartis Faces Fresh Legal Setback as Court Allows Kickback Case over MS Drug to Proceed

A former sales rep has accused Novartis of paying tens of millions of dollars in kickbacks to physicians to promote its multiple sclerosis drug, fingolimod. The whistleblower, Steven Campborn, alleges that lavish meals and so-called educational events were used as cover for influencing prescriptions.

Although lower courts had previously dismissed the case due to a lack of specific details, the Second Circuit Court of Appeals has now ruled in favor of the plaintiff, finding the allegations sufficiently detailed to move forward under the Anti-Kickback Statute and the False Claims Act.

According to the lawsuit, doctors and pharmacies who received benefits would go on to write prescriptions and submit reimbursement claims to federal health programs such as Medicare Part D, Medicaid, and TRICARE, raising concerns of systemic fraud.

The court also acknowledged that the alleged educational programs may have been a front for illegal marketing practices. This decision signals that pharmaceutical companies could be held accountable for using disguised promotional tactics that funnel government funds toward unnecessary prescriptions.
