The free trade zone may implement 6 new regulations for enterprises to file

On October 21, the 14th meeting of the Standing Committee of the 13th National People's Congress was held in Beijing. The meeting deliberated on the draft decision on Authorizing the State Council to temporarily adjust and implement relevant laws and regulations in the pilot free trade zone (hereinafter referred to as the draft). According to the draft, the State Council is authorized to temporarily adjust and implement the relevant provisions of six laws, including the road traffic safety law of the people's Republic of China, in the pilot free trade zone.

The first is to temporarily adjust and implement the tractor driving training school and driving training class qualification certification as stipulated in the road traffic safety law of the people's Republic of China, the foreign trade operator registration as stipulated in the foreign trade law of the people's Republic of China, and the fire protection technical service organization (belonging to intermediary service) as stipulated in the fire protection law of the people's Republic of China according to the way of directly canceling the approval. Organization) business license matters such as qualification examination and approval. During the pilot period, the above approval is suspended.

The second is to temporarily adjust and implement the food business license stipulated in the food safety law of the people's Republic of China (only selling prepackaged food) and the registration of customs declaration enterprises stipulated in the Customs Law of the people's Republic of China according to the way of changing approval to record. The enterprise can be engaged in the sales of prepackaged food and the customs declaration business after filing as required.

The third is to temporarily adjust and implement the provisions of the fire protection law of the people's Republic of China on fire safety inspection before public gathering places are put into use and open for business in accordance with the way of implementation of notification commitment. If the parties promise to meet the fire safety standards and provide relevant materials, the fire rescue agency will not conduct substantive review and make approval decision on the spot.

The fourth is to temporarily adjust and implement the relevant provisions of the seed law of the people's Republic of China in accordance with the way of optimizing the examination and approval services, cancel the examination (preliminary examination) link of the provincial forestry and grass department for the issuance of the production and operation license of forestry and grass seeds (import and export), and the applicant can directly apply to the State Forestry and grass Administration for the issuance of the license. When explaining the draft, Fu Zhenghua, Minister of justice, pointed out that with regard to the temporary adjustment of the time limit for the implementation of relevant laws and regulations, the draft made it clear that the above adjustments should be tried out within three years. If the practice proves feasible, the relevant laws shall be amended and perfected; if the practice proves unsuitable, the relevant laws and regulations shall be resumed. During the pilot process, the relevant departments under the State Council and the people's Government of the province (autonomous region, municipality directly under the central government) where the free trade pilot area is located will evaluate the pilot situation, and timely put forward suggestions on revising and improving relevant laws and regulations or resuming the implementation of relevant laws and regulations.
